特別の意図の証明
- 集団の全部または一部を破壊する具体的な意図である特別の意図は、そのための一般的な計画が存在することが説得力を持って証明されない限り、特定の状況を参照して説得力を持って示されなければならない。行動パターンがその存在を示す証拠として認められるためには、そのような意図の存在を指し示すようなものでなければならない。
- 特別の意図をあからさまに示すことはまれであるため、この推論が「証拠上利用可能な唯一の合理的な（1つの）推論（the only reasonable [one] available on the evidence）」である限り、「すべての証拠を総合して」大量殺戮の意図が存在することを推論することは許される。この分析に関連する要素としては、一般的な状況、同じ集団に対して組織的に行われた他の犯罪的行為の実行、残虐行為の規模、特定の集団に属していることを理由とする犠牲者の組織的標的化、破壊的・差別的行為の反復などが考えられる。計画や方針の存在、加害者が公の演説や他者との会合を通じて意思を示したことも、加害者が必要な具体的意思を形成していたという推論を支持することができる。

- ジェノサイドを行う意図を表明した国家計画がない場合、条約2条が意図する行為の加害者の個々の行為から、そのような意図を推論するプロセスを明確にすることが必要である。行為のパターンから特別の意図の存在を推論するためには、それが問題の行為から合理的に導き出される唯一の推論であることが必要かつ十分である（2007年判決で述べた基準は実質的にICTY基準と同一）。
